These Terms & Conditions govern the use of leafkettle.co.uk and purchases made from Leaf & Kettle. Please read them before placing an order. Nothing in these Terms affects your statutory rights as a consumer.

Leaf & Kettle is a UK business operated by Gary Scott as a sole trader, trading as Leaf & Kettle.

Our business/contact address is the address displayed on our website and in the information supplied to you before or at the time you place an order. You can contact us by email if you have any questions, complaints or queries about an order.
2. These Terms
By using our website or placing an order with us, you agree to these Terms & Conditions. If you place an order, the version of these Terms in force at the time of your order will apply to that purchase.
We may update these Terms from time to time, for example to reflect changes to our business, website, products or applicable law. Changes will not retrospectively alter a contract already made with you.
3. Products and Product Information
We take reasonable care to describe and display our products accurately. Product photographs are illustrative, and colours, finishes, grain, glaze, packaging and other details may vary slightly from what appears on your screen.
For natural, handmade or artisan-style products, minor variations may be part of the character of the product and are not necessarily defects.
Where food or drink products are offered, you should check the product packaging and information supplied with the product for ingredients, allergens, storage instructions, best-before information and preparation guidance. If you have an allergy or intolerance, please contact us before ordering if you need further information.
Product information may occasionally contain an obvious typographical, pricing or descriptive error. If we identify a material error affecting your order before dispatch, we will contact you and give you the option to proceed on the corrected basis or cancel for a full refund.
4. Placing an Order and Formation of the Contract
Products displayed on our website are an invitation to place an order. When you submit an order, you are offering to buy the products shown in your basket.
After you place an order, we will normally send an acknowledgement or confirmation email. An automated acknowledgement does not necessarily mean that we have accepted the order.
Our contract with you is formed when we accept your order, normally when the goods are dispatched or when we otherwise confirm acceptance. We may decline an order before acceptance, for example because a product is unavailable, payment has not been authorised, we cannot deliver to the address supplied, or we have identified an obvious error.
If we cannot accept an order after taking payment, we will refund the amount paid for the affected goods and any applicable delivery charge.
5. Prices and Payment
The price payable is the price shown at checkout when you place your order, subject to correction of obvious errors. Delivery charges, where applicable, will be shown before you complete payment.
Prices are shown in pounds sterling (GBP). Taxes will be handled in accordance with applicable law. Where we are required to charge VAT, the price shown to consumers will include VAT unless clearly stated otherwise.
Payment is processed through the payment methods made available at checkout. We do not normally receive or store your complete payment-card details ourselves; payment information is processed by the relevant payment provider.
Any optional additional charge will only be added where you have expressly selected or agreed to it.
6. Availability
All products are subject to availability. We try to keep stock information accurate, but occasionally an item may become unavailable after an order is placed.
If this happens, we may contact you to offer an alternative, wait for restocking where appropriate, or cancel the affected item and issue a refund. You are not required to accept a substitute.
Where an order contains several items, we may dispatch available items separately where reasonable. We will not charge additional delivery costs solely because we choose to split the shipment.
7. Delivery
Our current delivery services, prices, estimated delivery times and delivery areas are set out in our Shipping & Delivery Policy and at checkout. The delivery information displayed at checkout forms part of your order.
Estimated delivery times are estimates rather than guaranteed delivery dates unless we expressly agree a guaranteed date with you. We will deliver without undue delay and within the period required by applicable consumer law unless a different period has been agreed with you.
You are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you notice an error. We cannot guarantee that an address can be changed after an order has entered the dispatch process.
Risk in the goods passes to you when the goods come into your physical possession, or into the possession of a person you have identified to receive them, except where you independently arrange a carrier not offered by us.

8. Cancelling an Order
If you are a consumer buying online, you will normally have a legal right to cancel a purchase of goods without giving a reason. For most goods, the cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
Where one order is delivered in separate shipments, the cancellation period will normally run from receipt of the last of those goods where the law provides for this.
To cancel, you must tell us clearly that you wish to cancel. You can contact us at tea@leafkettle.co.uk. You do not have to use any particular wording.
If you cancel under your statutory cancellation right, you must normally return the goods within 14 days after telling us that you wish to cancel.
9. Returns and Refunds
Our Returns & Refunds Policy explains the practical process for returning goods. That policy operates alongside these Terms and does not reduce your statutory rights.
Where you validly exercise your statutory right to cancel, we will refund the price paid for the returned goods and, where required by law, the cost of our least expensive standard delivery option. If you chose a more expensive delivery service, the additional amount paid for that enhanced service is not normally refundable.
Unless the goods are faulty, not as described, or we have agreed otherwise, you are normally responsible for the direct cost of returning goods following a change-of-mind cancellation.
You may inspect goods as you reasonably would in a shop. We may make a deduction from a refund where permitted by law if the value of goods has been reduced because they have been handled beyond what is necessary to establish their nature, characteristics and functioning.
Where the statutory cancellation rules apply, refunds will be made within the applicable legal time limit, normally using the same payment method used for the original transaction unless otherwise agreed.
10. Exceptions to Change-of-Mind Cancellation Rights
Some goods are excluded from the usual statutory change-of-mind cancellation right. Depending on the product, this may include:
· goods made to your specifications or clearly personalised;
· goods which are liable to deteriorate or expire rapidly;
· sealed goods which are not suitable for return for health-protection or hygiene reasons once they have been unsealed after delivery; and
· goods which, after delivery, become inseparably mixed with other items.
An exception to the change-of-mind cancellation right does not remove your legal rights if goods are faulty, damaged, not as described or otherwise do not conform to the contract.
11. Tea, Food and Consumable Products
Tea and other consumable products should be stored and used in accordance with the instructions supplied with them. Please check packaging before use and do not consume a product if its packaging has been materially damaged or if you reasonably believe the product may be unsafe.
Some consumable products may fall within a statutory exception to the normal change-of-mind cancellation right, including where they are liable to deteriorate or expire rapidly or where a relevant sealed hygiene product has been opened. This does not affect your rights where the product is faulty, unsafe or not as described.
12. Faulty, Damaged or Misdescribed Goods
Goods must be of satisfactory quality, fit for any particular purpose made known to us where the law requires, and match their description. Your rights in relation to faulty or misdescribed goods are provided by consumer law and are not restricted by these Terms.
If you believe an item is faulty, damaged or not as described, please contact us at tea@leafkettle.co.uk with your order details and a description of the problem. Photographs can be helpful for transit damage, but requesting them does not remove your statutory rights.
Depending on the circumstances and your legal rights, the appropriate remedy may include a refund, repair, replacement or price reduction. Where the law requires us to bear reasonable return costs for faulty goods, we will do so.
13. Website Accounts
If you create an account, you are responsible for keeping your login details confidential and for providing accurate and current information.
Please tell us promptly if you believe your account has been accessed without permission. We may suspend or restrict an account where reasonably necessary to protect you, us or other users from fraud, abuse or security threats.
14. Acceptable Use of Our Website
You must not misuse our website. In particular, you must not knowingly:
· introduce viruses, malware or other harmful material;
· attempt to gain unauthorised access to the website, servers, accounts or connected systems;
· interfere with the normal operation or security of the website;
· use automated methods to scrape or extract substantial parts of the website where this is not permitted by law; or
· use the website for unlawful, fraudulent or abusive purposes.
We may restrict access where reasonably necessary to protect the website, our customers or our business.
15. Intellectual Property
Unless otherwise stated, the content of the Leaf & Kettle website, including our branding, logos, graphics, photographs, text, layout and other original material, is owned by or licensed to us and is protected by applicable intellectual property law.
You may view and use the website for your personal, non-commercial shopping purposes. You may not reproduce, distribute, sell, commercially exploit or create derivative works from our protected content without permission, except where the law permits.
16. Our Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods.
We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was made.
We supply products for private and domestic use unless we expressly agree otherwise. If you use products for commercial or business purposes, different rights and limitations may apply.
17. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, transport disruption, industrial action, widespread network or infrastructure failures, or other exceptional events.
If such an event materially affects your order, we will take reasonable steps to minimise the effect and will contact you where appropriate. Your statutory rights, including any right to cancel where applicable, are not affected.
18. Privacy and Personal Information
We process personal information in accordance with our Privacy Policy. Please read that policy for information about what we collect, why we use it, who we may share it with, how long we retain it and your data-protection rights.
Payment, ecommerce, analytics, marketing, delivery and other service providers may process information where necessary to provide their services to us, as explained in our Privacy Policy.
19. Promotions, Discount Codes and Gift Offers
From time to time we may offer promotions, discount codes, free gifts or other offers. Any additional terms displayed with an offer will apply to that promotion.
Unless we state otherwise, promotions cannot be exchanged for cash, may be limited by date, product, customer or order, and may not be combined with another promotion. We will not use promotional terms to remove or reduce statutory consumer rights.

If something has gone wrong, please contact us first so that we have an opportunity to resolve it.

Please include your order number where relevant and enough information for us to understand the issue. We aim to deal with complaints fairly and within a reasonable time.
21. General
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
If we delay in enforcing a right under these Terms, that does not mean we have waived that right.
These Terms are between you and us. No other person has a right to enforce them except where applicable law expressly provides otherwise.
22. Governing Law and Courts
These Terms and contracts made through our website are governed by the law of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you also retain any mandatory protections available to you under the law applicable to you, and you may have the right to bring proceedings in the courts of the part of the UK where you live. Nothing in these Terms is intended to deprive you of mandatory consumer protections.

If there is an inconsistency, mandatory consumer law will prevail. For practical matters such as current delivery prices and return instructions, the information shown in the relevant policy and at checkout should be followed, provided it does not reduce your statutory rights.
